Regulamin Sprzedaży

The online system allows for user registration, creation of an individual account, use of the full account functionality, including the purchase of tickets for the Club de Ultrace 2024 event organized by Go Hard LTD.

The purchase of tickets can be made through the service website ultraceofficial.com, starting from December 5, 2023, until stocks are exhausted.

The system administrator within the service is the Organizer.

Definitions

  1. Organizer/Seller – Go Hard LTD, located in Wrocław at Rafała Wojaczka 19/60, 51-169 Wrocław, Tax Identification Number: 8992795419. Event – Club de Ultrace 2024, taking place on June 29-30, 2024.
  2. Terms and Conditions – these present Ticket Sales Terms and Conditions.
  3. Registration – the process of registering on the Service to create an individual User account.
  4. User – a person registered on the website (possessing a login and password for the Service) and having an individual account on the ultraceofficial.com Service.
  5. Ticket – the entitlement of a specific Participant to enter the Club de Ultrace 2024 event on specified days, from June 29, 2024, to June 30, 2024, in a specified area. The ticket is in electronic form. Ticket sales begin on December 5, 2023.
  6. Force Majeure – circumstances arising from or attributable to actions, events, lack of events, or accidents beyond the reasonable foresight and control of the Organizer, including, but not limited to: collapse, flood, fire, explosion, earthquake, landslide, structural damage, epidemic or increased incidence and spread of infectious diseases (e.g., coronavirus), or other natural physical disasters, lack or insufficient supply of electricity, satellite connections and other communication links, military actions, riots, strikes, terrorist acts, social unrest, national mourning, decisions of investigative bodies, local government or government administration, occurring during the Club de Ultrace 2024 event or in the period preceding the event, if it prevents the organization of the event on the scheduled date.
  7. Adult – a natural person who has turned 18 years old at the latest on the day of the commencement of the Club de Ultrace 2024 event, i.e., on June 29, 2024, or has turned 18 on the given day of the event and provides a document confirming the completion of 18 years of age, or from which the completion of 18 years of age is evident (identity card, driver's license, passport, birth certificate).
  8. Uczestnik Imprezy – osoba, na którą został wystawiony Bilet na imprezę Club de Ultrace 2024.
  9. Registration – the process of registering on the Service to create an individual User account.
  10. Order – the Buyer's declaration of intent made through the Service, clearly specifying: the number of tickets for the Club de Ultrace 2024 event, the method of payment, and directly aiming to conclude a contract between the Organizer and the User. Placing and processing an order involves several stages, confirmed by the Organizer in the User's panel on the ultraceofficial.com Service, marked respectively as New Order, Paid Order, Order Sent. For the avoidance of doubt, the Order is a declaration covering all the stages mentioned in the previous sentence.
  11. Contract – a sales agreement for the Ticket/Tickets for the Club de Ultrace 2024 event, which will take place from June 29, 2024, to June 30, 2024.

I. General Provisions

  1. By logging into the Service and using the Service, the User accepts the terms specified in these Terms and Conditions.
  2. Użytkownik wyraża zgodę na to, by Organizator posługiwał się telefonem, pocztą elektroniczną, automatycznym urządzeniem wywołującym lub innym środkiem komunikacji elektronicznej dla celów korespondencyjnych (dobrowolnie).
  3. The User uses the Service on their own behalf.
  4. The User acknowledges that the condition for registration on the ultraceofficial.com Service and the purchase of Ticket/Tickets for the Club de Ultrace 2024 event is the acceptance of these Terms and Conditions, Privacy Policy, and consent to the processing of personal data for the above-mentioned purposes. During the registration process, the User may also consent to receive commercial information electronically, and to the processing of personal data by the Organizer or the Organizer's partners for marketing purposes.
  5. If the Organizer, due to a Force Majeure Event, is unable to fulfill in whole or in part any of its obligations arising from the ticket sale contract for the Club de Ultrace 2024 event, the Organizer will be released from the performance of the aforementioned obligation.
  6. The Organizer reserves the right to change the schedule of the Club de Ultrace 2024 event, the lineup of artists, the order of their appearances, or the duration of their performances without the right of the User or Participant to demand any compensation from the Organizer, or to obtain a refund of funds from the sale of Ticket/Tickets.
  7. The Organizer is not responsible for the provision of incorrect or false data by the User in the process of purchasing Ticket/Tickets for the Club de Ultrace 2024 event, which prevents or hinders the fulfillment of the Organizer's obligations arising from these Terms and Conditions.

II. Conclusion of the Contract

  1. The Seller of admission tickets for the Club de Ultrace 2024 event on the ultraceofficial.com Service is the Organizer.
  2. The sales contract between the User and the Organizer is concluded after the User has placed and confirmed the Order, paid, and received confirmation of the purchase of Ticket/Tickets from the Organizer to the User's email address. Ticket sales will begin on December 5, 2023.
  3. Payment of the Order, depending on the payment method chosen by the User, means the crediting of the payment for the Ticket/Tickets to the Przelewy24 bank account belonging to the Organizer.
  4. The Seller reserves that the Tickets are available until exhausted.

III. Registration in the Service and Logging into the Service

  1. Only a registered and logged-in User of the Service can purchase a Ticket for the Event.
  2. Registration to the Service is done by creating an individual account on the Service. To do this, the User fills out a form on the ultraceofficial.com website, providing data: email address, username, password, first name, last name, and contact phone number. The account can be linked by the User to a Facebook social media account after full registration to facilitate the login process in later stages of using the Service.
  3. Logging into the Service is possible after prior registration to the Service. Login is accomplished by the User providing a username (which is the email address) and password.

IV. The Purchase Process

  1. The process of purchasing Ticket/Tickets is possible after logging into a previously registered User account.
  2. The User selects products from the list presented and available on the website. The choice concerns Ticket/Tickets and additional products according to availability and the User's choice.
  3. The User makes a choice according to the successive steps of the Order and the method of payment.
  4. The only available forms of payment are through the Przelewy24 service. A link to make the payment is provided on the website in the User's panel and in an email sent by the Organizer after the User confirms the placement of the Order.
  5. The User is obliged to specify the delivery details for the Order – company name (if the delivery is to a company or workplace), first name, last name, street and property number, postal code, city, country (in case of international shipping), and contact phone number. The Organizer is not responsible for inaccuracies, errors, or imprecisions in the address provided by the User, which prevent the effective delivery of the Order.
  6. The final stage of the purchase process is the confirmation of the Order and making the payment.
  7. The acceptance of the Order is confirmed in an email sent by the Organizer immediately after the User makes the payment. Payment is understood as the crediting of the payment to the Przelewy24 bank account belonging to the Organizer.

V. Delivery and Personalization of the Ticket

  1. Orders confirmed by the Organizer are automatically sent by the System to the email address provided in the Order.
  2. In the event of non-delivery of the Order, the User has the right to contact the Organizer to clarify the matter. The Organizer will strive to explain the circumstances of the case and will inform the User by email about the results of the explanatory proceedings.
  3. The information visible on the ticket is the buyer's information.
  4. The ticket code is valid only upon first verification, the first person to present the ticket is considered the valid ticket holder.
  5. The details on the ticket do not have to match the details of the person using the ticket. The ticket is subject to one-time verification at the time of entry to the event - there is no possibility of reusing the ticket.
  6. Participation in the event is authorized only with a properly attached badge, the ticket must be personally exchanged for a badge at the first entry to the event.

VI. Additional conditions

  1. The user is obligated to verify the correctness of provided data before confirming the order. The user is responsible for the accuracy of data given in the system during registration, in the process of making a purchase, and in the process of personalization and activation of the Ticket/Tickets.
  2. The User acknowledges that any negative consequences resulting from the inability to unequivocally identify the data provided by the User are borne by the User.
  3. After confirming the order, there is no possibility of changing or cancelling it, it must be paid for according to the order, subject to the right to a refund in accordance with the provision of point XI of these Regulations.
  4. By using the Ticket, the Participant accepts the general terms and conditions set by the Organizer, in particular the Event Regulations and other Regulations, if they have been or will be issued by the Organizer in relation to the Event.
  5. The Organizer refuses to sell Tickets and entry to persons against whom a final judgment has been issued prohibiting entry to mass events or a final judgment obliging to refrain from staying in the places where mass events are held, issued by a court against a convict in connection with the conditional suspension of the sentence of deprivation of liberty or against a minor based on art. 6 point 2 of the Act of October 26, 1982 on proceedings in juvenile matters.
  6. The Organizer may refuse entrance to the Event to minors despite having a Ticket purchased in accordance with the Regulations, without the right to demand a refund of the paid price.

VII. Ticket price and Order value

  1. The price list containing a list of available Tickets along with the prices of additional products is provided by the Organizer on the website ultraceofficial.com.
  2. Tickets may be sold in batches, which means that the Organizer puts a specific number of tickets up for sale at a set price, and once all of those tickets have been sold, a new batch may be offered at a different price. Regardless of the above, the Organizer reserves the right to change the price of tickets at any time without giving a reason. The Organizer will announce any changes to ticket prices on the event's website, along with the new ticket price.
  3. The seller reserves the right to add a service charge to the total value of the Order made via the Service, for the handling and processing of the Order.
  4. The Organizer reserves the right that the total value of the Order placed in the Service includes the price for the Ticket/Tickets, additional products selected by the User, and potential postage or courier delivery costs.

VI. Additional conditions

  1. The Organizer is the administrator of the personal data database provided by the User.
  2. The Organizer is obliged to protect personal data in accordance with the Organizer's Privacy Policy and in accordance with generally applicable legal provisions.
  3. The user acknowledges that providing personal data, as referred to in the provisions of these Regulations, is necessary and required to place an Order and to conclude a Ticket/Tickets Sale Agreement.
  4. Detailed rules on the processing of personal data used for the implementation of the Order and in connection with the conclusion of the Agreement have been described in the Privacy Policy, which is located at: https://ultraceofficial.com
  5. The Organizer and the Organizer's commercial partners cooperating in the organization of the Event may use and process the User's or Participant's personal data for marketing purposes and the implementation of direct marketing activities using IT devices, provided that the User or Participant gives separate consent for the processing of personal data in this scope.

X. Returns

  1. The User has the right to return the purchased Ticket(s) and additional products within an inalienable deadline of 14 days from the day of placing the Order, which means the confirmation of the Order by the Organizer after the Order has been paid.
  2. The Organizer will refund the funds within 30 days from the day the User makes the return.
  3. The funds are refunded to the User in the method of payment chosen by the User when placing the Order. Only the funds spent on the sale price of the Ticket(s) or additional products are subject to refund. The Organizer does not refund the costs incurred for preparing the shipment, its implementation, and service costs.
  4. The Organizer reserves the right not to accept returns in the case of provision of false data, especially with respect to the date of birth.
  5. The organizer reserves the right not to accept returns in the event of providing incorrect information or information inconsistent with the identity document (identity card, driver's license, passport).
  6. The organizer has the right to verify the data from the Ticket with the identity document.
  7. The organizer reserves the right that no refunds will be accepted after the deadline mentioned in point 1 above, except for the situations indicated below:
    1. śmierć członka rodziny w linii prostej lub bocznej do II stopnia włącznie pokrewieństwa, lub powinowactwa, pod warunkiem przedstawienia wiarygodnego dokumentu potwierdzającego powyższą okoliczność,
    2. choroba lub zabieg/operacja (z wyłączeniem ciąży) uniemożliwiająca udział w Festiwalu pod warunkiem udokumentowania powyższej okoliczności informacją/zaświadczeniem od lekarza specjalisty lub z zakładu opieki zdrowotnej.
  8. The Organizer reserves the right to verify the grounds for making a refund in the aforementioned manner. The Organizer agrees to make a refund or refuses to make a refund, providing a justification. The Organizer's decision is final.
  9. A ticket refund is not possible within 7 calendar days prior to the start of the event.
  10. The above rules apply accordingly in the event of a cancellation of the Event due to attributable reasons on the part of the Organizer.

XI. Additional provisions

  1. The Organizer reserves the right to change the event's program, in particular the schedule, the lineup of artists, the order of their performances, or the duration of their performances, without the User's right to demand any compensation from the Organizer.
  2. The Organizer is not responsible for the User providing an incorrect or false mailing address, or other incorrect information that prevents the identification of the User.

XII. Withdrawal from the contract

  1. The organizer informs that, in accordance with article 38 point 12 of the Act of May 30, 2014 on Consumer Rights (i.e. of December 13, 2018, Journal of Laws from 2018, item 134 with later amendments), the User has no right to withdraw from the contract under the terms of article 27 of the aforementioned act.

XIII. Contact and correspondence with the Seller

  1. The Seller allows the User to make contact exclusively through the System.
  2. The user has the right to contact the Seller via the contact form available in the System.
  3. The Seller provides information about the Club de Ultrace 2024 Event in the System and on the website at: ultraceofficial.com. The Seller reserves the right not to respond to a question when the information concerning the question is available on the Event website.
  4. The Organizer reserves the right to consider the deadlines mentioned in these Regulations as observed, if the correspondence is sent by the User no later than the last day of the deadline.

XIV. Final Provisions

  1. In case of discrepancies between the provisions of this Regulations and the provisions of the Event Regulations, the provisions of this Regulations take precedence.
  2. The current version of the Terms and Conditions is always available in the Terms and Conditions tab on the website https://ultraceofficial.com during the execution of the Order and throughout the period after the execution of the User's Order, the User is bound by the Terms and Conditions accepted by him when placing the Order.
  3. In matters not regulated by these Terms and Conditions, the relevant applicable laws shall apply. Disputes shall be settled by the court having jurisdiction and subject matter for the Organizer's registered office.

Club de Ultrace 2024 Event Terms and Conditions

I. Definitions

  1. The regulations, referred to hereinafter as "Regulations", govern the conditions of participation in the Club de Ultrace 2024 event, particularly the safety rules, admission to the event, and organization of the event.
  2. Whenever the Regulations mention:
    1. The term "organizer" refers to: Go Hard LLC, located in Wroclaw, at Rafala Wojaczka Street 19/60, postal code 51-169
    2. The term is understood as follows: the act of March 20, 2009, on the security of mass events (i.e. of September 14, 2018, as amended. Journal of Laws from 2018, item 1870)
    3. Tickets should be understood as the entitlement of a specific Participant to enter the Event on a specified day, to a specified area. The ticket is in electronic form, which is exchanged for a wristband.
    4. By event, it is meant the event conducted under the name Club de Ultrace 2024 (hereinafter referred to as the Event) in the period from June 29, 2024 to June 30, 2024.
    5. The term "Event Area" should be strictly understood as the area where concerts, exhibitions, motorsport zones, gastronomic zone take place during the Event.
    6. The participant of the Event should be understood as a natural person participating in the Event on the basis of a Ticket.
    7. The term of selling tickets should be understood as the Regulations of selling tickets for the Club de Ultrace 2024 published at the address: https://ultraceofficial.com.
    8. Security services should be understood as: persons appointed by the Organizer, including employees of personal or property security agencies, who present an ID placed in a visible spot containing: the issuer's name, identification number and photograph, validity period, seal and signature of the issuer in order to ensure the safety of people participating in the Event on the premises of the Event and in places designated by the Organizer. In exercising their powers, the Event security services are particularly entitled to control the participants' rights to enter the Event site, to check the state of sobriety and intoxication by other means.
    9. By Force Majeure, this shall be understood to mean circumstances resulting from or attributable to actions, events, lack of events or accidents, which the Organizer could not have foreseen within the boundaries of common sense, and which are beyond the control of the Organizer, including but not limited to: collapse, flood, fire, explosion, earthquake, landslide, structural damage, epidemic or increased incidence and spread of infectious diseases (e.g. coronavirus) or another natural physical disaster, lack or insufficient supply of electricity, satellite connections and other communication connections, military actions, riots, strikes, terrorist actions, social unrest, national mourning, decision of investigative bodies, local government or government administration, occurring during the Event and in the period preceding the Event, when it prevents the organization of the Event or prevents the continuation of the Event according to the schedule.
  3. The regulations apply to all Event Participants who will be on the premises where the Event is organized during its duration.
  4. Each Participant present at the Event site during its duration is obligated to abide by the provisions of this Regulation. By purchasing and presenting a Ticket, the Event Participant confirms that they are familiar with the Event Regulations.

II. General Rules

  1. Wstęp na teren Imprezy przysługuje osobie, posiadającej Bilet.
  2. Entrance to the Event area is only granted to a Participant with an undamaged Ticket, including an undamaged wristband, i.e. not torn, cut or otherwise mechanically damaged.
  3. The ticket code is valid only upon first verification; the first person to present the ticket is the one the specific ticket applies to. There is no possibility of reusing the ticket.
  4. Tickets for participation in the Event are sold through the online service on the website. https://ultraceofficial.com, starting from December 5, 2023 until stocks run out.
  5. It is forbidden to dispose of a Ticket for the benefit of third parties, both for a fee and free of charge, especially the resale of Tickets at auctions, tenders, or conducted in any other way indicating the profitable nature of such resale. Any public offering of the transfer of Ticket ownership, including as awards in competitions, lotteries, premium sales, or any other promotions, even if it is free of charge, is prohibited unless the Organizer gives prior consent. In case of identifying breaches, the Organizer reserves the right to deny the Participant's entry to the Event area and participation in the Event.
  6. Tickets can only be sold at the price set by the Organizer. Violation of the above prohibition constitutes an offense defined in art. 133 of the Misdemeanor Code Act.
  7. In the event that a disabled person and their carer intend to participate in the Event, each of these persons is obliged to purchase Tickets.
  8. The organizer reserves the right, in accordance with the provisions of the Act, to refuse entry to the event area or to order its immediate exit:
  9. osobom, wobec których zostało wydane orzeczenie zakazujące wstępu na imprezę masową lub zobowiązujące do powstrzymania się od przebywania w miejscach przeprowadzania imprez masowych, wydane przez sąd wobec skazanego w związku z warunkowym zawieszeniem wykonania kary pozbawienia wolności albo wobec nieletniego na podstawie art. 6 pkt. 2 ustawy z dnia 26 października 1982 r. o postępowaniu w sprawach nieletnich, a także osobom, wobec których został wydany zakaz zagraniczny lub klubowy w rozumieniu Ustawy,osobom, które odmawiają poddania się czynnościom:
    a) verification of rights to stay on the Event premises,
    b) for identification purposes to establish their identity and confirm their adulthood,
    c) inspection of the contents of luggage, clothing of individuals, in case of suspicion that these individuals are bringing in or possess dangerous items, especially weapons, sharp tools, substances prohibited by law, alcohol. The evaluation of items and their qualification as dangerous is the prerogative of the Security Services.
    d) to enable the Security Services to determine the rights of individuals to stay in the event area,
    e) failure to comply with the request to leave the Event;
    f) failure to comply with the instructions of security services by people disturbing public order or behaving contrary to the regulations of the mass event;
  10. persons under the visible influence of alcohol, intoxicating substances, psychotropic or other similarly acting substances,
  11. to individuals possessing weapons or other dangerous objects, explosives, pyrotechnic products, fire hazardous materials, alcoholic beverages purchased from places other than those designated by the Organizer, intoxicating substances or psychotropic substances.
  12. to individuals behaving aggressively, provocatively, or in any other way posing a threat to safety or public order.
  13. Persons not possessing a valid document entitling them to participate in the Event,
  14. to people wearing shoes with metal ends,
  15. persons whose appearance prevents identification,
  16. to individuals possessing plastic, glass, or metal containers, or cans etc.
  17. to persons whose behavior or statements expose the Organizer to the loss of good reputation, or violate the personal rights of the Organizer, or act to the detriment of the Organizer, or the event's brand.

III. Additional rights, duties and declarations

  1. Each person who has purchased a Ticket for the Event is obliged to familiarize themselves with the Regulations. The purchase of a Ticket is conditional and unequivocally associated with the acceptance of the Regulations and the adoption of its provisions without reservations.
  2. The Event Participant acknowledges that by taking part in the Event, they will constantly be in the area of loud sounds, which can cause hearing damage. Strobe lights and lasers, as well as other types of light and sound effects, will be used during the Event.
  3. The Organizer, within the scope defined by the Act and implementing regulations, is entitled to record the course of the Event, and in particular the behavior of individuals, using image and sound recording devices.
  4. The Event Participant, by purchasing a Ticket and participating in the Event, acknowledges that the Organizer also records the course of the Event for documentation purposes and for the promotion or advertising of the Event and future editions of the Event in the following years, as well as for the promotion of the Organizer or Media Partners and Sponsors of the Event.
  5. Every Participant of the Event, by participating in the Event, consents to the capture of their image at the Event, and then to the dissemination of the captured image for documentation, reporting, advertising, and promotional purposes.
  6. The materials collected during the recording of the Event, which may constitute evidence allowing for the initiation of criminal proceedings or proceedings in matters of misdemeanours or evidence significant for ongoing such proceedings, the Organizer immediately transfers to the appropriate district prosecutor or the Police. Materials collected during the recording of the Event, which do not contain evidence allowing for the initiation of criminal proceedings or proceedings in matters of misdemeanours or evidence significant for ongoing such proceedings, not used for advertising purposes, are kept after the conclusion of the Event for a period of at least one month, and then are subject to commission destruction.

IV. Event Organization

  1. The organizer reserves the right to change the start and end times of the Event without giving any reason.
  2. The Organizer reserves the right to cancel the Event without giving a reason. In case of cancellation of the Event due to reasons dependent on the Organizer, the Organizer will refund the cost of purchased tickets to the Participants of the Event on the terms specified in this Regulations and the ticket sales regulations available on the website: https://ultraceofficial.com
  3. The Organizer reserves the right to change the Event program, in particular the performance times of individual performers, the order of performances of individual performers, and the cancellation of a given performer's performance.
  4. The Organizer informs that due to the large number of Participants, Participants are obliged to arrive at the Event venue with an appropriate, at least 2-hour lead time.
  5. The organizer informs that the event map along with the program for each day of the event is published and available on the event's website no later than 3 days before the start of the event.

V. Cancellation of the Event

  1. An unused ticket does not entitle to a refund or exchange for another, except in the case of cancellation of the event due to reasons dependent on the Organizer and subject to the provisions of the ticket sales regulations.
  2. The organizer only refunds the price of the ticket.
  3. In the event of cancellation of the Event, changes in the program, changes in the schedule, changes in the time or place of the Event, the Organizer will inform about this fact by placing the relevant information on the website www.ultraceofficial.com or directly during the Event.
  4. The Organizer is not responsible for the effects of Force Majeure or third parties. The Organizer is not responsible for the cancellation of the Event due to reasons on the part of third parties or due to the occurrence of Force Majeure. In the aforementioned cases, the Organizer does not refund the funds spent on the purchase of the ticket.
  5. The Organizer is not responsible for the Participant providing an incorrect or false correspondence address or other data necessary for verification.
  6. Organizator zastrzega sobie prawo do zmiany programu Imprezy bez podania przyczyny i bez ponoszenia jakiejkolwiek odpowiedzialności z tego tytułu wobec Uczestnika.
  7. Detailed regulations regarding the return of Tickets and refunds in connection with the cancellation of the Event due to the Organizer's fault are included in the Ticket Sales Regulations.

VI. Event Security

  1. The Organizer ensures safety to the persons present at the Event and order during the Event, including through:
  2. Order Services distinguished by elements of their attire, duly trained to perform the tasks entrusted to them in the field of mass event protection;
  3. providing medical assistance and hygienic-sanitary facilities;
  4. change of the Event's location to another, if such a need arises, without stating a reason.
  5. Event participants and all other individuals on the event grounds are obliged to follow the instructions of the Order Services and Information Services.
  6. Participants of the Event, as well as all other people who are present at the Event, are obliged to behave in a manner that does not endanger the safety of other people present at the Event, and in particular, to comply with the provisions of the Rules.
  7. Participants of the Event, as well as all other people who are present at the Event, are obliged to behave in a manner that does not endanger the safety of other people present at the Event, and in particular, to comply with the provisions of the Rules.
  8. In case of a damaged Ticket, the event Participant is required to immediately report to the point designated by the Organizer with the damaged Ticket for its exchange.
  9. The Organizer designates Zones for the division of the Event area, in particular:
  10. Technical and social facilities,
  11. Sectors, audience - area of a mass event,
  12. Entrances and exits of the main,
  13. Parking Area,
  14. Permanent security points by security services,
  15. Gastronomic zones - designated and enclosed gastronomic and commercial zones, where alcohol is sold, are excluded from the mass event area and only in these zones can the alcohol purchased there be consumed.
  16. The organizer ensures fire safety by ensuring that:
  17. Staff, Security Services, and the Organizer must know the location of portable fire-fighting equipment and hydrants, as well as procedures in case of fire;
  18. Order Services must be trained in: evacuation procedures, how to alert the fire brigade, the use of handheld fire-fighting equipment, and how to provide first aid.
  19. Security Services may issue their own security and fire protection instructions in accordance with applicable laws.
  20. During the Event, the Organizer and the Event Participants, as well as other people present at the Event site, are required to comply with the provisions of the Act on Upbringing in Sobriety and Counteracting Alcoholism.
  21. Visitors may be present at the Event Venue only during the opening hours of the event or other events, subject to fulfilling safety procedures, in accordance with the current guidelines of the Chief Sanitary Inspector (GIS) during an epidemic, which may include:
  22. the requirement to complete an epidemiological declaration containing information that the Visitor, to the best of their knowledge, is not an infected person and is not in quarantine or under epidemiological supervision,
  23. The event venue, pavilions, stands or other exhibits and passages in pavilions and entrance doors to pavilions may be temporarily closed or with limited access, limited to the number of people who can be in a given area at one time, for organizational or safety reasons and at this time unavailable to Visitors.
  24. the obligation of the Visitor to provide themselves with personal protective equipment,
  25. obligation to maintain social distancing appropriate to the nature of the fair or other event,
  26. mandate to follow the procedure in the event of suspected infection (e.g. coronavirus) in a Visitor, which may include the obligation to provide data of people with whom the Visitor had contact at the Event Site, indication of the area where the Visitor stayed or the obligation to stay in an isolated room.
  27. obligation to comply with the announcements made by the Event Organizers regarding safety procedures.

VII. Security Services

  1. Security Services, identifying themselves with an identifier placed in a visible location, are authorized according to the provisions of the Act to:
  2. verification of individuals to establish their identity,
  3. inspection of the contents of baggage, clothing of individuals, in case of suspicion that these individuals bring in or possess dangerous items, intoxicating substances, psychotropic substances or other items threatening human life and health;
  4. determining the rights of individuals to attend the Event, and in case of lack of such rights - asking them to leave the Event;
  5. issuing orders to persons disturbing public order or behaving contrary to the mass event regulations, and in case of non-compliance with these orders - calling on them to leave the Event;
  6. application of physical force in the form of immobilizing grips and similar defense techniques in the event of a threat to goods entrusted to security or repulsion of an attack on a member of the Order Service or another person, on the principles set out in art. 36 of the Act of August 22, 1997 on the protection of persons and property (consolidated text of October 25, 2018 Journal of Laws 2018, item 2142 as amended),
  7. in order to immediately pass on to the Police, people posing a direct threat to human life or health, as well as protected property.
  8. Security services are obliged to remove from the event area those individuals who, by their behavior, disturb public order or act contrary to the Regulations or other regulations issued on the basis of or in connection with this Regulation, which stipulate the rules of participation in the Event.
  9. Members of the Security Services may be equipped with, among others:
    a) handheld metal detectors,
    b) other necessary and legally permitted means of personal protection.

  11. In the case of detecting items in the examined baggage or clothing, the possession and bringing of which are prohibited at the Event, the security services refuse entry to the Event to the person found in possession of these items or remove them from the area.
  12. In the event of detecting weapons or other dangerous items, alcoholic beverages, explosives, pyrotechnic and fire-hazardous materials, and narcotic and psychotropic substances in the inspected baggage or clothing, the Order Services will apprehend the person found with these items in their inspected baggage or clothing and, after confiscating them, will draw up a protocol of this operation and then hand this person over to the Police, along with the confiscated items.
  13. Persons who have been denied entry to the Event area or are staying there, or Participants removed from the Event area in accordance with the Regulations or the Act due to their violation, are not entitled to a refund for the Ticket.

VIII. Prohibitions

  1. Bringing in dangerous items, including weapons, firecrackers, flares, tear gas, stun guns, etc.
  2. Bringing in alcohol and intoxicants, including psychotropic substances.
  3. Bringing in personal drinks other than those containing alcohol.
  4. Bringing in closed packages, parcels, etc.
  5. Bringing in dangerous objects that threaten, or whose improper use threatens human life and health,
  6. Bringing in liquids in glass bottles, including perfumes,
  7. It is prohibited to destroy signs and information boards, advertising materials, equipment and appliances located at the Event area, etc.
  8. It is forbidden to obstruct, block in any way exits and evacuation routes, access routes for rescue services as well as hydrants and other devices necessary in case of conducting rescue or firefighting operations.
  9. Participants are obliged to use the sanitary facilities strictly in accordance with their purpose.
  10. It is forbidden to sleep in cars or other means of transportation in the Event's parking lot.
  11. It is forbidden to conduct any commercial or other profitable activity, as well as advertising and promotional activity at the Event site without the Organizer's authorization.
  12. The Event Participant is informed about the criminal liability arising from the Act according to which:
    a) Anyone who does not comply with the organisational order, issued under the Act or Regulations by the Organizer or Security or Information Services, is subject to arrest, restriction of freedom or a fine.
    b) Anyone who brings or possesses at the Event any weapons, other dangerous objects, explosives, pyrotechnic products or fire hazardous materials, is subject to arrest or restriction of freedom.
  13. The organizer does not provide a deposit for items whose bringing and possession is prohibited during the event.

IX. Final provisions

  1. All rights to the name and logo of the Event are reserved for the Organizer. Official programs and gadgets related to the Event will be sold only on the premises of the Event or in sales points authorized by the Organizer.
  2. The final interpretation of this Regulation belongs exclusively to the Organizer.

  6. In matters not regulated by the Regulations, the provisions of the Act apply.
  7. The Organizer reserves that the detailed rules applicable during the Event in various Event Zones, including the parking area, will be regulated in separate rules issued on the basis of this Regulation.
  8. The Organizer reserves the right to change or supplement this Regulation at any time. Information about the change of the Regulation will be made public on the Event website.
  9. The regulation comes into effect on the day of publication.

Club de Ultrace 2024 Event Terms and Conditions

I. Definitions

  1. The regulations, referred to hereinafter as "Regulations", govern the conditions of participation in the Club de Ultrace 2024 event, particularly the safety rules, admission to the event, and organization of the event.
  2. Whenever the Regulations mention:
    1. The term "organizer" refers to: Go Hard LLC, located in Wroclaw, at Rafala Wojaczka Street 19/60, postal code 51-169
    2. The term is understood as follows: the act of March 20, 2009, on the security of mass events (i.e. of September 14, 2018, as amended. Journal of Laws from 2018, item 1870)
    3. Tickets should be understood as the entitlement of a specific Participant to enter the Event on a specified day, to a specified area. The ticket is in electronic form, which is exchanged for a wristband.
    4. By event, it is meant the event conducted under the name Club de Ultrace 2024 (hereinafter referred to as the Event) in the period from June 29, 2024 to June 30, 2024.
    5. The term "Event Area" should be strictly understood as the area where concerts, exhibitions, motorsport zones, gastronomic zone take place during the Event.
    6. The participant of the Event should be understood as a natural person participating in the Event on the basis of a Ticket.
    7. The term of selling tickets should be understood as the Regulations of selling tickets for the Club de Ultrace 2024 published at the address: https://ultraceofficial.com.
    8. Security services should be understood as: persons appointed by the Organizer, including employees of personal or property security agencies, who present an ID placed in a visible spot containing: the issuer's name, identification number and photograph, validity period, seal and signature of the issuer in order to ensure the safety of people participating in the Event on the premises of the Event and in places designated by the Organizer. In exercising their powers, the Event security services are particularly entitled to control the participants' rights to enter the Event site, to check the state of sobriety and intoxication by other means.
    9. By Force Majeure, this shall be understood to mean circumstances resulting from or attributable to actions, events, lack of events or accidents, which the Organizer could not have foreseen within the boundaries of common sense, and which are beyond the control of the Organizer, including but not limited to: collapse, flood, fire, explosion, earthquake, landslide, structural damage, epidemic or increased incidence and spread of infectious diseases (e.g. coronavirus) or another natural physical disaster, lack or insufficient supply of electricity, satellite connections and other communication connections, military actions, riots, strikes, terrorist actions, social unrest, national mourning, decision of investigative bodies, local government or government administration, occurring during the Event and in the period preceding the Event, when it prevents the organization of the Event or prevents the continuation of the Event according to the schedule.
  3. The regulations apply to all Event Participants who will be on the premises where the Event is organized during its duration.
  4. Each Participant present at the Event site during its duration is obligated to abide by the provisions of this Regulation. By purchasing and presenting a Ticket, the Event Participant confirms that they are familiar with the Event Regulations.

II. General Rules

  1. Wstęp na teren Imprezy przysługuje osobie, posiadającej Bilet.
  2. Entrance to the Event area is only granted to a Participant with an undamaged Ticket, including an undamaged wristband, i.e. not torn, cut or otherwise mechanically damaged.
  3. The ticket code is valid only upon first verification; the first person to present the ticket is the one the specific ticket applies to. There is no possibility of reusing the ticket.
  4. Tickets for participation in the Event are sold through the online service on the website. https://ultraceofficial.com, starting from December 5, 2023 until stocks run out.
  5. It is forbidden to dispose of a Ticket for the benefit of third parties, both for a fee and free of charge, especially the resale of Tickets at auctions, tenders, or conducted in any other way indicating the profitable nature of such resale. Any public offering of the transfer of Ticket ownership, including as awards in competitions, lotteries, premium sales, or any other promotions, even if it is free of charge, is prohibited unless the Organizer gives prior consent. In case of identifying breaches, the Organizer reserves the right to deny the Participant's entry to the Event area and participation in the Event.
  6. Tickets can only be sold at the price set by the Organizer. Violation of the above prohibition constitutes an offense defined in art. 133 of the Misdemeanor Code Act.
  7. In the event that a disabled person and their carer intend to participate in the Event, each of these persons is obliged to purchase Tickets.
  8. The organizer reserves the right, in accordance with the provisions of the Act, to refuse entry to the event area or to order its immediate exit:

    a) verification of rights to stay on the Event premises,
    b) for identification purposes to establish their identity and confirm their adulthood,
    c) inspection of the contents of luggage, clothing of individuals, in case of suspicion that these individuals are bringing in or possess dangerous items, especially weapons, sharp tools, substances prohibited by law, alcohol. The evaluation of items and their qualification as dangerous is the prerogative of the Security Services.
    d) to enable the Security Services to determine the rights of individuals to stay in the event area,
    e) failure to comply with the request to leave the Event;
    f) failure to comply with the instructions of security services by people disturbing public order or behaving contrary to the regulations of the mass event;
  10. persons under the visible influence of alcohol, intoxicating substances, psychotropic or other similarly acting substances,
  11. to individuals possessing weapons or other dangerous objects, explosives, pyrotechnic products, fire hazardous materials, alcoholic beverages purchased from places other than those designated by the Organizer, intoxicating substances or psychotropic substances.
  12. to individuals behaving aggressively, provocatively, or in any other way posing a threat to safety or public order.
  13. Persons not possessing a valid document entitling them to participate in the Event,
  14. to people wearing shoes with metal ends,
  15. persons whose appearance prevents identification,
  16. to individuals possessing plastic, glass, or metal containers, or cans etc.
  17. to persons whose behavior or statements expose the Organizer to the loss of good reputation, or violate the personal rights of the Organizer, or act to the detriment of the Organizer, or the event's brand.

III. Additional rights, duties and declarations

  1. Each person who has purchased a Ticket for the Event is obliged to familiarize themselves with the Regulations. The purchase of a Ticket is conditional and unequivocally associated with the acceptance of the Regulations and the adoption of its provisions without reservations.
  2. The Event Participant acknowledges that by taking part in the Event, they will constantly be in the area of loud sounds, which can cause hearing damage. Strobe lights and lasers, as well as other types of light and sound effects, will be used during the Event.
  3. The Organizer, within the scope defined by the Act and implementing regulations, is entitled to record the course of the Event, and in particular the behavior of individuals, using image and sound recording devices.
  4. The Event Participant, by purchasing a Ticket and participating in the Event, acknowledges that the Organizer also records the course of the Event for documentation purposes and for the promotion or advertising of the Event and future editions of the Event in the following years, as well as for the promotion of the Organizer or Media Partners and Sponsors of the Event.
  5. Every Participant of the Event, by participating in the Event, consents to the capture of their image at the Event, and then to the dissemination of the captured image for documentation, reporting, advertising, and promotional purposes.
  6. The materials collected during the recording of the Event, which may constitute evidence allowing for the initiation of criminal proceedings or proceedings in matters of misdemeanours or evidence significant for ongoing such proceedings, the Organizer immediately transfers to the appropriate district prosecutor or the Police. Materials collected during the recording of the Event, which do not contain evidence allowing for the initiation of criminal proceedings or proceedings in matters of misdemeanours or evidence significant for ongoing such proceedings, not used for advertising purposes, are kept after the conclusion of the Event for a period of at least one month, and then are subject to commission destruction.

IV. Event Organization

  1. The organizer reserves the right to change the start and end times of the Event without giving any reason.
  2. The Organizer reserves the right to cancel the Event without giving a reason. In case of cancellation of the Event due to reasons dependent on the Organizer, the Organizer will refund the cost of purchased tickets to the Participants of the Event on the terms specified in this Regulations and the ticket sales regulations available on the website: https://ultraceofficial.com
  3. The Organizer reserves the right to change the Event program, in particular the performance times of individual performers, the order of performances of individual performers, and the cancellation of a given performer's performance.
  4. The Organizer informs that due to the large number of Participants, Participants are obliged to arrive at the Event venue with an appropriate, at least 2-hour lead time.
  5. The organizer informs that the event map along with the program for each day of the event is published and available on the event's website no later than 3 days before the start of the event.

V. Cancellation of the Event

  1. An unused ticket does not entitle to a refund or exchange for another, except in the case of cancellation of the event due to reasons dependent on the Organizer and subject to the provisions of the ticket sales regulations.
  2. The organizer only refunds the price of the ticket.
  3. In the event of cancellation of the Event, changes in the program, changes in the schedule, changes in the time or place of the Event, the Organizer will inform about this fact by placing the relevant information on the website www.ultraceofficial.com or directly during the Event.
  4. The Organizer is not responsible for the effects of Force Majeure or third parties. The Organizer is not responsible for the cancellation of the Event due to reasons on the part of third parties or due to the occurrence of Force Majeure. In the aforementioned cases, the Organizer does not refund the funds spent on the purchase of the ticket.
  5. The Organizer is not responsible for the Participant providing an incorrect or false correspondence address or other data necessary for verification.
  6. Organizator zastrzega sobie prawo do zmiany programu Imprezy bez podania przyczyny i bez ponoszenia jakiejkolwiek odpowiedzialności z tego tytułu wobec Uczestnika.
  7. Detailed regulations regarding the return of Tickets and refunds in connection with the cancellation of the Event due to the Organizer's fault are included in the Ticket Sales Regulations.

VI. Event Security

  1. Order Services distinguished by elements of their attire, duly trained to perform the tasks entrusted to them in the field of mass event protection;
  2. providing medical assistance and hygienic-sanitary facilities;
  3. change of the Event's location to another, if such a need arises, without stating a reason.
  4. Event participants and all other individuals on the event grounds are obliged to follow the instructions of the Order Services and Information Services.
  5. Participants of the Event, as well as all other people who are present at the Event, are obliged to behave in a manner that does not endanger the safety of other people present at the Event, and in particular, to comply with the provisions of the Rules.

  7. In case of a damaged Ticket, the event Participant is required to immediately report to the point designated by the Organizer with the damaged Ticket for its exchange.
  8. The Organizer designates Zones for the division of the Event area, in particular:

  10. Sectors, audience - area of a mass event,
  11. VIP Zone,
  12. Entrances and exits of the main,
  13. Parking Area,
  14. Permanent security points by security services,
  15. Gastronomic zones - designated and enclosed gastronomic and commercial zones, where alcohol is sold, are excluded from the mass event area and only in these zones can the alcohol purchased there be consumed.
  16. The organizer ensures fire safety by ensuring that:
  17. Staff, Security Services, and the Organizer must know the location of portable fire-fighting equipment and hydrants, as well as procedures in case of fire;
  18. Order Services must be trained in: evacuation procedures, how to alert the fire brigade, the use of handheld fire-fighting equipment, and how to provide first aid.
  19. Security Services may issue their own security and fire protection instructions in accordance with applicable laws.
  20. During the Event, the Organizer and the Event Participants, as well as other people present at the Event site, are required to comply with the provisions of the Act on Upbringing in Sobriety and Counteracting Alcoholism.

  5. determining the rights of individuals to attend the Event, and in case of lack of such rights - asking them to leave the Event;
  6. issuing orders to persons disturbing public order or behaving contrary to the mass event regulations, and in case of non-compliance with these orders - calling on them to leave the Event;

  13. The organizer does not provide a deposit for items whose bringing and possession is prohibited during the event.

IX. Final provisions

  1. All rights to the name and logo of the Event are reserved for the Organizer. Official programs and gadgets related to the Event will be sold only on the premises of the Event or in sales points authorized by the Organizer.
